PLEASE READ THIS TERMS OF USE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING, BROWSING, OR USING THE SITE, OR BY SUBMITTING ANY INFORMATION THROUGH THE SITE, YOU ("USER," "YOU," OR "YOUR") ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND EXPRESSLY AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. 1. NO ATTORNEY-CLIENT RELATIONSHIP FORMED
1.1 Information Only. All materials, text, images, articles, insights, newsletters, and other content available on or through this Site (collectively, "Content") are provided solely for informational, educational, and marketing purposes. The Content does not constitute, and shall not be construed as, legal advice on any matter whatsoever.
1.2 No Formation of Relationship. Your use of this Site, your receipt or transmission of information via this Site, or your electronic communication with the Firm via contact forms, emails, or chat features does not create, constitute, or imply an attorney-client relationship between you and Aligned Law Office or any of its attorneys.
1.3 Requirement of Express Written Agreement. An attorney-client relationship with Aligned Law Office can only be formed through an explicit, bilateral, written engagement agreement signed by an authorized attorney of the Firm and the client, which expressly outlines the scope of representation and fee structures in accordance with Texas law.
2. TEXAS ATTORNEY ADVERTISING & ETHICAL DISCLOSURES
2.1 Texas Disciplinary Rules Compliance. This Site is intended to comply with all applicable legal and ethical requirements, specifically including the Texas Disciplinary Rules of Professional Conduct (TDRPC) Part VII (Information About Legal Services).
2.2 Principal Office & Responsible Attorney. For the purposes of compliance with TDRPC Rule 7.02(c), the principal office of Aligned Law Office is located in Texas, and the Managing Attorney of Aligned Law Office is the attorney responsible for the content of this Site.
2.3 No Guarantee of Outcomes. Any informational descriptions of past legal matters, case results, or testimonials found on this Site are illustrative only. Prior results do not guarantee, predict, or warrant a similar outcome in any future legal matter.
2.3 Jurisdictional Limitations. While this Site may be viewed globally, the Firm’s attorneys are licensed to practice law only in the jurisdictions explicitly listed within their respective individual professional biographies. The availability of this Site is not an offer to represent you and is not intended to solicit clients outside the jurisdictions where our attorneys are licensed to practice.
3. CONFIDENTIALITY AND ELECTRONIC COMMUNICATIONS
3.1 Communications Are Not Confidential. Unless you are an existing client of the Firm with a fully executed engagement agreement, any communication or information you send to the Firm via the Site, email, or contact forms is not secure, will not be treated as confidential, and is not protected by the attorney-client privilege.
3.2 Conflict of Interest Risks. Do not send sensitive, proprietary, or confidential information through this Site. If you submit information to us prior to a formal engagement, that information will not prevent Aligned Law Office from representing an adverse party in your matter, and such information may be subject to disclosure.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 Firm Ownership. Aligned Law Office fully owns, licenses, and retains all right, title, and interest in and to the Site, its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), which are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
4.2 Limited License. You are granted a non-exclusive, non-transferable, revocable, limited license to access and print pages from the Site solely for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Content without the express, prior written consent of Aligned Law Office.
5. PROHIBITED USES
You agree to use the Site only for lawful purposes. You are strictly prohibited from using the Site:
In any way that violates applicable federal, state, local, or international law.
To transmit or procure the sending of any advertising or promotional material, including "junk mail," "spam," or similar solicitations.
To impersonate or attempt to impersonate Aligned Law Office, a Firm employee, or any other person or entity.
To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm the Firm or users of the Site.
To introduce any viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful material, or attempt to gain unauthorized access to the Site’s hosting servers or databases.
6. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ALIGNED LAW OFFICE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, OR ERROR-FREE OPERATION. THE FIRM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALIGNED LAW OFFICE, ITS PARTNERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SITE. UNDER NO CIRCUMSTANCES WILL THE FIRM BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SITE. THE TOTAL LIABILITY OF THE FIRM TO YOU FOR ANY CLAIMS ARISING FROM THIS AGREEMENT OR YOUR USE OF THE SITE SHALL NOT EXCEED $100 USD.
8. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Aligned Law Office, its partners, members, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of this Agreement; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
9. GOVERNING LAW AND JURISDICTION
9.1 Governing Law. This Agreement, its interpretation, and any disputes or claims arising out of or in connection with it or its subject matter shall be governed by, construed, and enforced exclusively in accordance with the internal laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule.
9.2 Exclusive Venue. You expressly agree that any legal suit, action, or proceeding arising out of, or related to, this Agreement or the Site shall be instituted exclusively in the federal or state courts located in the State of Texas, in the county where the Firm maintains its primary principal office. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
10. SEVERABILITY AND MANDATORY AMENDMENTS
10.1 Severability. If any provision of this Agreement is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of the Agreement will continue in full force and effect.
10.2 Right to Modify. Aligned Law Office reserves the right, in its sole discretion, to modify, alter, or update this Agreement at any time. Changes become effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your binding acceptance of the revised Terms.
